Contracts are a fundamental tool of business. They enable parties who might have quite different interests to conduct transactions in a mutually beneficial manner. These varying interests of the parties mandate that each obtain the experienced advice of counsel in the negotiation and drafting of the agreements prior to signing them. However, no matter how well negotiated and drafted a contract is, and for as long as contracts have existed, there have been disputes over the performance of parties.

As a corporate executive or business owner, you undoubtedly have had at least one serious disagreement concerning the provision of goods or services. You may have already tried to work out an agreement with the other party only to come to an impasse. In this situation, you need cogent advice concerning your legal options.

Before recommending litigation, however, I also consider other dispute resolution methods. Sometimes, a brisk and sharply worded communication from my office is sufficient to induce the other party to engage in meaningful negotiations. In other cases, I suggest exploring the possibility of alternative dispute resolution techniques such as mediation or arbitration. When it appears that these methods will not be fruitful, then I will recommend aggressive litigation to protect my clients' rights and interests.
